Throughout this Agreement you will be known as the “User”. The service we provide will be referred to as “Service” and Vendors that User may be in touch with will be referred to as “Vendor”.
Findmydress.net is a forum that facilitates communication between User and Vendor for services related to weddings. Findmydress.net acts as a platform for Vendors and purchasers of wedding services to exchange information with the goal of eventually forming a business relationship. Findmydress.net does not guarantee that User will successfully find a Vendor to his/her liking through this system. Likewise, Find My Dress does not involve itself in any agreement between User and Vendor. We do not guarantee the completion of any agreement between User and Vendor. User is solely responsible for assessing the integrity, honesty, experience, capability, and reliability of any Vendor with whom User communicates through this Website.
The inclusion of any Vendor on this website does not imply an endorsement of any subscribing service Vendor. Findmydress.net makes no representation regarding any Vendor’s qualifications, nor does it sanction any statement a Vendor may post on the Website or communicate to the User. Find My Dress does not screen any potential Vendor.
User understands and acknowledges that Findmydress.net is not liable for any dispute, claim, controversy, or lawsuit that Vendor and User may have against each other arising from the use of this Website and Service.
User understands and acknowledges that while there is no charge or fee to User for the use of this Service, Vendor does pay a fee to Findmydress.net in order to use this Service and solicit business from User.
By signing up on Findmydress.net you agree that you consent to receive communications from us electronically regarding offers or other website related information.
User agrees that Findmydress.net is not responsible for any harm that this Service may cause. User unconditionally and absolutely agrees to indemnify and hold Findmydress.net fully harmless from any and all liability arising from or in connection with the contents or use of the Service. User further agrees that the defense and indemnity shall include without limitation attorney’s fees and costs.
You hereby grant to Findmydress.net and its affiliates a non-exclusive, royalty-free, irrevocable, perpetual, transferable, sublicensable, worldwide right to use, reproduce, edit, market, store, distribute, have distributed, publicly and privately display, communicate, publicly and privately perform, transmit, have transmitted, create derivative works based upon and promote your images (as such may be edited and modified by us in our sole and absolute discretion), or any portion thereof, through Findmydress.net and any other products or services as we may designate, in any medium now known or hereafter devised, online or offline and by any means of delivery, for editorial, commercial, promotional and all other purposes.
You agree that all of your images submitted on Findmydress.net has all necessary releases and permissions required to grant the licenses granted under the applicable license, including without limitation, valid model and property releases to allow us to depict recognizable people (living or dead) and private properties, and that you have been granted written permission regarding all distinguishable trademarks.
You represent and warrant to us: (a) your submitted images do not and shall not infringe on any copyright or any other third-party right nor violate any applicable law or regulation; (b) all necessary releases and permissions required to grant the above-referenced license have been obtained in writing, including without limitation, valid model and property releases to allow any Publisher to depict recognizable people (living or dead) and private properties; (c) you have written permission regarding all distinguishable trademarks; and (d) you have the right to grant any and all necessary rights and licenses provided herein, including, without limitation, all necessary copyright and other related rights to your submitted images, free and clear of all claims and encumbrances without violating the rights of any person or entity, including any right to privacy or publicity. We reserve the right to remove your submitted or accepted images from its network and our network (as applicable) for any or no reason at its (and our) sole and absolute discretion.
Findmydress.net may change the Agreement at any time. Findmydress.net further reserves the right to discontinue the Website without notice. Findmydress.net reserves the right to change the company name and domain name at any time, and all contracts will carry over to the new name. User agrees that Findmydress.net shall not be liable to User or any third party for any modification or discontinuance of the Service. User acknowledges and agrees that any termination of Service may be without prior notice and agrees that Findmydress.net may immediately delete data and files in the User’s account and bar any further access to the files.
User expressly agrees that the use of the Service is at User’s own risk. The Service is provided on an “as is” basis. Findmydress.net expressly disclaims all warranties of any kind, whether expressed or implied, including, but not limited to the implied warranties of merchantability and fitness for a particular purpose. Findmydress.net makes no warranty that the Service will meet User’s requirements, that the Service will be uninterrupted, timely, secure, or error-free. Furthermore, Findmydress.net does not warranty as to the results that may be obtained from the use of the Service or as to the accuracy or reliability of any information obtained through the Service or that defects in the program will be corrected. Findmydress.net makes no warranty regarding any goods or services purchased or information obtained through the Service or any transaction entered through the Service. No advice or information, whether oral or written, obtained by User from Findmydress.net shall create any warranty not expressly stated herein.
User Review is an open forum where past clients can leave Reviews about their experiences with their vendors. It is important to note that, in most cases, Reviews are unfiltered and permanent, unless vulgar or slanderous. It is the duty of the vendor to notify Findmydress.net to dispute any unwanted review. At which time Findmydress.net reserves the right to moderate and accept or reject the review.
Findmydress.net shall not be liable for any direct, indirect, incidental, special, or consequential damages resulting from the use or inability to use the Service, including but not limited to any damage caused by Vendor in dealing with User. Furthermore, User agrees that Findmydress.net shall not be liable for any damages arising from interruption, suspension, or termination of service, including, but not limited to, direct, indirect, incidental, special, or consequential damages, whether such interruption, suspension, or termination was justified or not, negligent or intentional.
Any claims or disputes arising out of this Agreement, including any claims for violation of the terms of the Agreement, shall be resolved under the laws of the State of Texas and shall be subject to arbitration. The arbitration shall be conducted in the County of El Paso, State of Texas, and any court having jurisdiction thereof may enter judgment on the arbitration award.
If any term or provision of this Agreement is held to be invalid, illegal or unenforceable in any respect as written, the parties intend for any arbitrator construing this Agreement to modify or limit such provision so as to render it valid and enforceable to the fullest extent allowable by law. Any provision not susceptible of such reformation shall fully be valid and enforced of the law. Furthermore, the provisions of this Agreement are severable, meaning that if any part is found to be unenforceable or inoperable, then such provision will be deemed severed, and all other parts will remain fully valid and enforceable.
